Principles of data processing at Messe Offenbach GmbH

These data protection provisions address women and men equally. For better readability, only the masculine form of language is used (e.g. exhibitor, visitor, applicant, etc.).

I. Principles

Messe Offenbach GmbH appreciates your visit to our website and your interest in our company and our products. We take the protection of your private data seriously and we want you to feel comfortable when visiting our website. The protection of your privacy is of utmost importance to us. Therefore, compliance with the legal provisions on data protection is a matter of course for us. Our employees are bound to data secrecy and are regularly trained in the areas of data protection and data security. In the following, we would like to briefly explain how we protect your data and what it means for you when you use our online services.

II.  General information on data processing

1. Range of the processing of personal data

As a matter of principle, we only process personal data of our users insofar as this is necessary for the provision of a functional website as well as our contents and services. The processing of personal data of our users is regularly only carried out with the consent of the user. An exception applies in those cases in which obtaining prior consent is not possible for actual reasons and the processing of the data is permitted by legal regulations.

2. Legal basis for the processing of personal data
Insofar as we obtain the consent of the data subject for processing operations involving personal data  Art. 6 Para. 1 lit. a EU General Data Protection Regulation (DSGVO) serves as the legal basis. When processing personal data that is necessary for the performance of a contract to which the data subject is a party, Art. 6 Para. 1 lit. b DSGVO serves as the legal basis. This also applies to processing operations that are necessary for the performance of pre-contractual measures. Insofar as processing of personal data is necessary for compliance with a legal obligation to which our company is subject, Art. 6 Par. 1 lit. c DSGVO serves as the legal basis. In the event that vital interests of the data subject or another natural person make the processing of personal data necessary, Art. 6  1 lit. d of the GDPR serves as the legal basis.

If the processing is necessary to protect a legitimate interest of our company or a third party and the interests, fundamental rights and freedoms of the data subject do not outweigh the first-mentioned interest Art. 6 Para. 1 lit. f DSGVO serves as the legal basis for the processing.

3. Data deletion and storage period
The personal data of the data subject shall be deleted or blocked as soon as the purpose of storage ceases to apply. Storage may also take place if this has been provided for by the European or national legislator in Union regulations, laws or other provisions to which the controller is subject. The data will also be blocked or deleted if a storage period prescribed by the aforementioned standards expires, unless there is a necessity for the continued storage of the data for the conclusion or fulfilment of a contract.

III. Providing the website and creating log files

1. Description and scope of data processing
Each time our website is accessed, our system automatically collects data and information from the computer system of the accessing computer.

The following data is collected:

  1. the name of your internet service provider
  2. the country you come from
  3. the website from which you are visiting us
  4. the search term, if you come to our site via a search engine
  5. the websites you visit with us
  6. the user tool (web browser, operating system) with which you accessed it
  7. Files you have downloaded from our site (e.g. PDF or Word documents)
  8. the duration as well as
  9. the date and time of the visit

The log files contain IP addresses or other data that enable an assignment to a user. This could be the case, for example, if the link to the website from which the user arrives at the website or the link to the website to which the user goes contains personal data. This data is also stored in the log files of our system. This data is not stored together with other personal data of the user.

2. Legal basis for data processing
The legal basis for the temporary storage of data and log files is  Art. 6 Par. 1 lit. f DSGVO.

3. Purpose of data processing
The temporary storage of the IP address by the system is necessary to enable delivery of the website to the user’s computer. For this purpose, the user’s IP address must remain stored for the duration of the session. The storage in log files is done to ensure the functionality of the website. In addition, we use the data to optimise the website and to ensure the security of our information technology systems. An evaluation of the data for marketing purposes does not take place in this context. These purposes are also our legitimate interest in data processing according to Art. 6 Abs. 1 lit. f DSGVO.

4. Duration of storage
The data is deleted as soon as it is no longer required to achieve the purpose for which it was collected. In the case of the collection of data for the provision of the website, this is the case when the respective session has ended.

In the case of storage of data in log files, this is the case after seven days at the latest. Storage beyond this period is possible. In this case, the IP addresses of the users are deleted or alienated so that an assignment of the calling client is no longer possible.

5. Possibility of objection and removal
The collection of data for the provision of the website and the storage of the data in log files is absolutely necessary for the operation of the website. Consequently, there is no possibility for the user to object.

IV. Personal data

Personal data is individual information about personal or factual circumstances of a specific or identifiable natural person. This includes information such as your name, postal or e-mail address. Personal data is only stored by us in addition to access data if you provide it voluntarily, e.g. as part of a registration, a survey, a competition, a contact enquiry, a newsletter subscription or to place an online order. Furthermore, personal data will only be used to the extent necessary and only for the purpose you have consented to or for the legally permissible purpose. For the secure transmission of your data, Messe Offenbach GmbH uses encryption procedures in secured areas. This means that communication between your browser and, for example, our ordering system cannot be read by others on the Internet. Furthermore, the use of our ordering system constitutes consent to the storage and use of your data by Messe Offenbach GmbH and its partners.

Why should you share your personal data with Messe Offenbach GmbH?
By sharing your personal data, we can offer you a number of benefits. It will be easier and more convenient for you,

  • to plan your visit to the fair because we can send you targeted specialist information in advance of an event,
  • to register your visit to the fair at selected events so that you receive all the benefits to which the electronic purchase of your card entitles you,
  • to receive personal communications and special offers from us or our exhibitors,
  • to plan and implement your trade fair appearance smoothly and benefit from a wide range of services offered by Messe Offenbach GmbH,
  • to save time for what is really interesting.

By sharing your data, you also enable us to conduct market research so that we can provide you with better services and customer service and further optimise our offers. Personal data will only be transferred to state institutions and authorities in the context of legal or judicial obligations.

V. Use of cookies

a) What are cookies all about?
Cookies are text information (ASCII text) that are stored on your hard drive via your browser (e.g. Microsoft Explorer or Mozilla Firefox). If you do not want us to process your personal data that you have not sent us directly, please let us know at info@messe-offenbach.de. If you send us e-mails, we will collect, process and use your personal data for the purpose of handling our range of services, including corresponding correspondence. The same applies if you send us contact forms, letters or faxes. Of course, you can object to the use of your data for the purpose of contacting customers at any time. You will be regularly informed of your right to object in all information and advertising letters.

For your security, we have taken all necessary technical and organisational measures to protect the collected, processed and used data from loss, destruction, falsification, manipulation, unauthorised access and unauthorised disclosure. Our employees are also bound to data secrecy. They are regularly trained in the areas of data protection and data security.

VI. Registration

1. Description and scope of data processing
On our website, we offer users the opportunity to register by providing personal data. The data is entered in an input mask and transmitted to us and stored. The data is not passed on to third parties. The following data is collected during the registration process:

  1. Company headquarters
  2. Address data
  3. Salutation
  4. Name, first name
  5. Numbers; telephone, fax, mobile phone
  6. Email Adress
  7. Visitor category
  8. Industry
  9. Number of employees

The following data is also stored at the time of registration:

  • The IP address of the user
  • Date and time of registration

As part of the registration process, the user’s consent to the processing of this data is obtained.

The legal basis for the processing of data is Art. 6 para. 1 lit. a DSGVO.

3. Purpose of data processing
A registration of the user is necessary for the provision of certain contents and services on our website.

4. Duration of storage
The data is deleted as soon as it is no longer required to achieve the purpose for which it was collected. This is the case for the data collected during the registration process when the registration on our website is cancelled or modified.

5. Possibility of objection and removal
As a user, you have the option of cancelling your registration at any time. You can have the data stored about you changed at any time.

VII. Data protection for special applications

 1. Online services and forms
On our website you have the possibility to request services of Messe Offenbach GmbH via online forms and services. For these services, personal data is collected which is necessary for the execution of the respective service. You decide whether to provide us with this information online.

If no further reason is given that requires you to provide your e-mail address, fax number or telephone number, you can optionally provide these contact options. By doing so, you agree that we can also contact you in this way in order to clarify open points.

Storage period
Your personal data will only be stored in the online forms and services for as long as is necessary for the use of the respective service. A storage of the data due to legal regulations in further technical systems or files remains unaffected.

We will provide you with detailed and specific data protection information on your request in the respective service description or via the online form or the online service you have requested.

2. Online orders
You can order information material (e.g. catalogues, visitor brochures) online. As part of the ordering process, we receive necessary data from you to process the order and to carry out the agreed services. Data fields with which necessary data for the processing of the business process are collected are always marked separately (with an asterisk) as mandatory fields.

3. Online-Ticketing / -Registrierung (Ticket Shop)
We offer you the service of buying tickets online and/or registering as a trade visitor in our ticket shop.

When you use our ticket shop, we receive the necessary data from you to process the order and to perform the agreed services. Data fields with which necessary data for the processing of the business process are collected are always marked separately (with an asterisk) as mandatory fields. In addition, further details, including industry, professional position, area of responsibility and areas of interest, are also mandatory fields. These data form a valuable basis for tailoring the professional orientation and development of our event to your needs and profile. Furthermore, it is possible for us to send you specialist information relevant to you in advance of an event. You have the right to information, correction, deletion or blocking of your personal data. If you wish your personal data stored with us to be deleted, this request will be complied with immediately, unless there are documentation or storage obligations that prevent deletion. You can object to the use of your data for the above-mentioned purposes at any time or revoke any consent you have given.

Furthermore, we offer you the possibility to correct or change the data entered during registration – with the exception of the first and last name. Such changes can easily be made under “Edit personal data”. If you have an invitation from an exhibitor and redeem it in the Ticket Shop, your data (first and last name, company, e-mail address) and when you visited the trade or consumer fair will be transmitted to the inviting exhibitor. Our data protection concept also includes service partners who process data on our behalf and who may need your data to complete an order to your full satisfaction.

For security reasons, the password you choose when registering should be at least eight characters long and contain a special character (such as @) as well as upper and lower case letters and numbers. Trivial passwords should be avoided. Your password will be stored by us in encrypted form. We or the service providers commissioned by us use encryption procedures for the secure transmission of your data. This means that the communication between your browser and our ordering system cannot be read by other participants on the Internet.

It is not our intention to process/forward personal data without your consent and for purposes other than those declared when collecting the data. The use of your personal data on these pages takes place within the framework of the current data protection laws exclusively for the proper processing of business and for customer service purposes.

4. Surveys
We enable participation in interactive surveys so that users can easily share their opinions with other users and find out what our visitors think about important issues. Surveys also help us to better target our content and services to our clientele. We use a system of ‘tagging’ users according to how they vote, so that they can only cast one vote on a particular question. There is no correlation between this tagging and information about individual users. At our own discretion, we share the demographic information accumulated in these polls with the rest of the users of the portal, but never your personal information.

VIII. Web services

1. Google Remarketing
This website uses Google Re-Marketing. Google Re-Marketing is an advertising service provided by Google Inc. (Google, Mountain View, USA), which enables us to provide you with targeted advertising of presumed interest to you based on your usage behaviour during previous visits to our website. This advertising only appears on Google advertising spaces, either Google Adwords or the Google Display Network. Users are identified via a cookie set in the web browser. The information on Google Analytics and the use of the IP address apply to the collection, storage and processing of the data collected. In the context of re-marketing, Google will not merge IP addresses or personal data with other Google data, in particular usage data. The duration of the re-marketing cookies is 18 months. You can object to Google re-marketing in the Google Ads Preferences Manager (https://www.google.com/settings/u/0/ads?hl=de) or edit your settings. Alternatively, you can prevent re-marketing by disabling cookies in your browser settings. This website uses Google Analytics demographic reports, which use data from Google’s interest-based advertising and third-party visitor data (e.g. age, gender and interests).

2. Google+

4. Google Maps
The Messe Offenbach GmbH website uses Google Maps (API) from Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). If the user does not agree to the future transmission of his data to Google in the context of the use of Google Maps, it is possible to completely deactivate the Google Maps web service by switching off the JavaScript application in the user’s browser. Google Maps and thus also the map display on the Messe Offenbach GmbH website can then not be used.

5. YouTube

IX. Messe Offenbach Social Sign-in

Description of the application: Social Sign-in or Social Login is an application that is used for the registration process in a protected area. When registering with a social media profile, the existing information about the user is automatically saved in the user administration of the Messe Offenbach GmbH website. A new user profile is created in the process. At the time of logging in with the social network identifier, the API queries the personal data from the network and transfers it to the database of Messe Offenbach. By connecting to the social network, Messe Offenbach GmbH automatically receives the data required for a login process in the respective system.

X. Photo / video recordings at events and dates of Messe Offenbach

For publication in print products and electronic publications of Messe Offenbach GmbH, on the commercial websites and social media channels (Facebook, Twitter, Instagram and YouTube), photos and / or videos are created at events / dates of Messe Offenbach GmbH. Personal data will be collected from you when the photos / videos are taken with digital devices.

Information
If photos/video are taken at a public event/date of Messe Offenbach GmbH, you will be informed of this in advance and at the respective event via notices and the contact persons will be named.

Purpose of data processing
The photos / videos will be used by Messe Offenbach GmbH for reporting in press releases, publications, on the internet and social media channels. The photos / videos are used by the specialist departments for internal and external documentation.

Legal basis for data processing
The legal basis for the processing of personal data is Article 6(1)(e) of the GDPR in conjunction with the relevant task standard or in conjunction with §3 paragraph 1 HDSIG.

Recipients or categories of recipients of the data
Recipients may be: Intranet, Internet visitors, website hosters, the operators of the social media channels used by Messe Offenbach GmbH (see above), press companies, subscribers to press releases, newsletters or the official journal of Messe Offenbach GmbH as well as printers and advertising agencies.

Transfer of personal data to a third country
If the photos / videos are published in the social media channels of Messe Offenbach GmbH, you will find more detailed information on the individual social media channels and their handling of personal data under the privacy policy of the respective provider. Furthermore, there are no plans to transfer the photos / videos to other third countries or international organisations.

Storage period
The photographs / videos will be deleted as soon as the purpose of storage no longer applies. Please note that photographs and videos of public events and photographs / videos with public figures (VIP) of Messe Offenbach GmbH are stored permanently for archiving purposes.

XI. Message Boards / Forums

Message boards and forums are used to engage in lively, unmoderated conversations on a variety of topics. We require users to register on a personal and company basis to prevent misuse of these platforms.

XII. Prize competition

Where we run loyalty programmes or prize competitions, all rules and information about the respective procedure and the use of personal data during the term of the programme will be clearly stated. The information collected is incidentally used to verify the user identity and to notify the winners or prize winners. Here too, Messe Offenbach GmbH will not pass on information about specific persons to third parties.

XIII.Job offer / Security advice on e-mail traffic

Messe Offenbach GmbH makes every effort to store your personal data in such a way that it is not accessible to third parties by taking all organisational and technical measures. When communicating by e-mail, Messe Offenbach cannot guarantee complete data security due to the lack of an unencrypted communication channel, so we recommend that you send confidential information by post. Messe Offenbach GmbH is authorised to send unencrypted information to the sender at this e-mail address if the sender does not revoke his consent to this procedure or objects to it in advance.

XIV. Contact form and e-mail contact

1. Description and scope of data processing
Our website contains a contact form that can be used for electronic contact. If a user takes advantage of this option, the data entered in the input mask is transmitted to us and stored. These data are:

  1. Name, first name
  2. Firmenname
  3. Email Adress
  4. Subject
  5. Message text

The following data is also stored at the time of registration:

  • The IP address of the user
  • Date and time of registration

The user’s consent to the processing of this data is obtained as part of the registration process. Alternatively, it is possible to contact us via the e-mail address provided. In this case, the user’s personal data transmitted with the e-mail will be stored. In this context, the data will not be passed on to third parties. The data is used exclusively for processing the conversation.

2. Legal basis for data processing
The legal basis for the processing of data is Art. 6 para. 1 lit. a DSGVO. The legal basis for the processing of data transmitted in the course of sending an e-mail is Art. 6 Para. 1 lit. f DSGVO. If the e-mail contact aims at the conclusion of a contract, the additional legal basis for the processing is Art. 6 Para. 1 lit. b DSGVO.

3. Purpose of data processing
The processing of the personal data from the input mask serves us solely to process the contact. In the case of contact by e-mail, this also constitutes the necessary legitimate interest in processing the data. The other personal data processed during the sending process serve to prevent misuse of the contact form and to ensure the security of our information technology systems.

4. Duration of storage
The data is deleted as soon as it is no longer required to achieve the purpose for which it was collected. For the personal data from the input mask of the contact form and those sent by e-mail, this is the case when the respective conversation with the user has ended. The conversation is ended when the circumstances indicate that the matter in question has been conclusively clarified. The additional personal data collected during the sending process will be deleted after a period of seven days at the latest.

5. Possibility of objection and removal
The user has the possibility to revoke his consent to the processing of personal data at any time.   3. the recipients or categories of recipients to whom the personal data concerning you have been or will be disclosed;
  4. the planned duration of the storage of the personal data relating to you or, if specific information on this is not possible, criteria for determining the storage duration;
  5. the existence of a right to rectify or erase personal data concerning you, a right to have processing restricted by the controller or a right to object to such processing;
  6. the existence of a right of appeal to a supervisory authority;
  7. any available information on the origin of the data if the personal data are not collected from the data subject;
  8. to the existence of automated decision-making, including profiling, in accordance with Art. 22 para. 1

and 4 DSGVO and – at least in these cases – meaningful information about the logic involved and the scope and intended effects of such processing for the data subject. You have the right to request information on whether personal data concerning you are transferred to a third country or to an international organisation. In this context, you may request to be informed about the appropriate safeguards pursuant to Art. 46 DSGVO in connection with the transfer.

2. Right to rectification
You have a right to rectification and/or completion vis-à-vis the controller if the personal data processed concerning you are inaccurate or incomplete. The controller shall carry out the rectification without undue delay.

3. Right to restriction of processing
Under the following conditions, you may request the restriction of the processing of personal data concerning you:

  1. if you contest the accuracy of the personal data concerning you for a period enabling the controller to verify the accuracy of the personal data;
  2. the processing is unlawful and you refuse to erase the personal data and instead request the restriction of the use of the personal data;
  3. the controller no longer needs the personal data for the purposes of processing, but you need it for the assertion, exercise or defence of legal claims, or
  4. if you object to the processing pursuant to Art. 21 para. 1 DSGVO and it is not yet clear whether the legitimate reasons of the controller outweigh your reasons.

Where the processing of personal data relating to you has been restricted, such data may be processed, with the exception of storage, only with your consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of substantial public interest of the Union or a Member State. If the restriction of processing has been restricted in accordance with the above conditions, you will be informed by the controller before the restriction is lifted.

4. Right to erasure
a) Obligation to erase
You may request the controller to erase the personal data concerning you without delay, and the controller is obliged to erase this data without delay, if one of the following reasons applies:

  1. The personal data concerning you are no longer necessary for the purposes for which they were collected or otherwise processed.
  2. You revoke your consent on which the processing is based pursuant to Art. 6 para. 1 lit. a or Art. 9 2 lit. a DSGVO) and there is no other legal basis for the processing.
  3. You object to processing pursuant to Art. (1)(2) of the GDPR against the processing and there are no overriding legitimate grounds for the processing, or you object to the processing pursuant to Art. 21 Para. 2 DSGVO against the processing.
  4. The personal data concerning you has been processed unlawfully.
  5. The deletion of the personal data concerning you is necessary for compliance with a legal obligation under Union or Member State law to which the controller is subject.
  6. The personal data concerning you were collected in relation to information society services offered pursuant to Art. 8 para. 1 DSGVO.

5. Information to third parties
If the controller has made the personal data concerning you public and is required to do so pursuant to Art. 17 para. 1 DSGVO, he or she shall take reasonable steps, including technical measures, to inform data controllers processing the personal data that you, as the data subject, have requested erasure of all links to or copies or replications of the personal data, taking into account the available technology and the cost of implementation.

6. Exceptions
The right to erasure does not exist insofar as the processing is necessary

  1. to exercise the right to freedom of expression and information;
  2. for compliance with a legal obligation which requires processing under Union or Member State law to which the controller is subject or for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller;
  3. for reasons of public interest in the field of public health pursuant to Art. 9 para. 2 lit. h and i as well as Art. 9 Para. 3 DSGVO;
  4. for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes pursuant to Art. (1)(2) of the GDPR, insofar as the right referred to in Section (a) is likely to render impossible or seriously prejudice the achievement of the purposes of such processing, or
  5. for the assertion, exercise or defence of legal claims.

7. Right to information
If you have exercised the right to rectification, erasure or restriction of processing vis-à-vis the controller, the controller is obliged to inform all recipients to whom the personal data concerning you have been disclosed of this rectification or erasure of the data or restriction of processing, unless this proves impossible or involves a disproportionate effort. You have the right against the controller to be informed about these recipients.

8. Right to data portability
You have the right to receive the personal data concerning you that you have provided to the controller in a structured, commonly used and machine-readable format. You also have the right to transfer this data to another controller without hindrance from the controller to whom the personal data has been provided, provided that

  1. the processing is based on consent pursuant to Art. 6 para. 1 lit. a DSGVO or Art. 9 Abs. 2 lit. a DSGVO or on a contract according to Art. 6 Paragraph 1 lit. b DSGVO and
  2. the processing is carried out with the aid of automated procedures.

In exercising this right, you also have the right to have the personal data concerning you transferred directly from one controller to another controller, insofar as this is technically feasible. This must not affect the freedoms and rights of other persons.

The right to data portability shall not apply to processing of personal data necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

9. Right of objection
You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data relating to you which is carried out on the basis of Art. 6 para. 1 lit. e or f DSGVO; this also applies to profiling based on these provisions. The controller shall no longer process the personal data concerning you unless it can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the purpose of asserting, exercising or defending legal claims. If the personal data concerning you is processed for the purposes of direct marketing, you have the right to object at any time to the processing of personal data concerning you for the purposes of such marketing; this also applies to profiling insofar as it is related to such direct marketing. If you object to the processing for direct marketing purposes, the personal data concerning you will no longer be processed for these purposes. You have the possibility, in connection with the use of information society services, notwithstanding Directive 2002/58/EC, to exercise your right to object by means of automated procedures using technical specifications.
